Terms of Service

PLEASE READ THESE TERMS CAREFULLY

By accessing or using the services offered by Chief AI Wiz, including any associated content, materials, programs, courses, live training, digital products, and custom AI tools (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of our websites, including chiefaiwiz.com and academy.chiefaiwiz.com (the “Sites”), and all products and programs offered through them. If you do not agree to all of these Terms, do not access or use our Services.

Chief AI Wiz and La Gurú de IA are brands owned and operated by 10X Cloud Value LLC, a Florida limited liability company. Our courses, community, and digital products are hosted on academy.chiefaiwiz.com via Kajabi, a third-party platform. Custom AI tools, or GPTs, may be hosted on ChatGPT via OpenAI, a separate third-party platform.

1. Eligibility

By using the Services, you confirm that you are 18 years of age or older and capable of entering into binding contracts. The Services are not directed to children under 13. If we learn that a child under 13 has provided personal information without verifiable parental consent, we will delete that information.

2. Program and Product Access and Duration

You are granted access to the program, course, or product you purchased, along with its associated materials, for the duration specified at the time of purchase, starting from your purchase or program start date. This includes recordings, resources, live sessions, downloadable materials, and any custom AI tools included with your purchase. Access to custom AI tools, or GPTs, hosted on ChatGPT is limited to the terms of the purchased course or program, with a maximum duration of one year unless otherwise stated.

3. No Sharing of Access

Access to any program, course, or product is for individual use only. Sharing your access credentials, or allowing others to view or participate under your account, is strictly prohibited. Violation of this term may result in immediate termination of your access without refund.

4. Payment Terms

Payment for all Services must be made in full at the time of registration unless an installment plan has been agreed upon in writing. All payments are processed through our third-party platforms. All sales are final as described in Section 5.

5. No Refunds and Cancellation Policy

By registering for any program, course, or digital product with Chief AI Wiz, you acknowledge and agree that no refunds or cancellations are allowed. All sales are final due to the live and digital nature of the Services. Once payment is made, it cannot be refunded, even if you are unable to attend or complete the program.

6. Subscriptions and Automatic Renewal

Where a Service is offered on a subscription basis, your subscription will renew automatically at the end of each billing period unless you cancel before the renewal date. No refunds are issued after a renewal has been processed. You can manage or cancel your subscription at any time from your account profile.

7. Recording Consent and Likeness Release

By registering for or participating in any Chief AI Wiz live training session, you acknowledge and grant permission to be recorded. These recordings may capture your voice, image, and any content you share during the sessions. You grant 10X Cloud Value LLC and Chief AI Wiz the right to use these recordings, and your image, likeness, voice, and any statements or content you share during live sessions or in the community platform, for training, marketing, sales, promotional, and any other lawful purposes, in perpetuity. This release applies to all materials captured during live sessions or posted in the community. Chief AI Wiz retains full ownership of all materials, recordings, and content created during live sessions.

8. Intellectual Property and Limited License

All content, materials, and resources provided through the Services, including courses, videos, PDFs, recordings, community content, and custom AI tools or GPTs, are the exclusive intellectual property of 10X Cloud Value LLC. You are granted a non-transferable, non-exclusive, revocable license to use these materials solely for your own personal use. Redistributing, copying, modifying, reselling, or sharing any materials without written authorization is strictly prohibited. Violations will result in immediate cancellation of access without refund and may result in legal action.

9. Confidentiality

The materials within our products and services are confidential. Sharing, distributing, or using them outside their intended purpose will result in account suspension and may result in legal action for damages.

10. Affiliate Disclosure

Some of the links provided in our programs, community, or materials may be affiliate links, meaning Chief AI Wiz may earn a commission if you make a purchase through those links.

11. Use of Custom AI Tools (GPTs)

Some Services include access to custom AI tools, or GPTs, created and hosted on ChatGPT via the OpenAI platform. Access is limited to the terms of the purchased course or program, with a maximum duration of one year unless otherwise stated. We do not have access to any data you enter into these GPTs within ChatGPT. Any data you enter in ChatGPT is governed by the OpenAI Privacy Policy.

12. Third-Party Platforms

Our courses, community, and digital products are hosted on academy.chiefaiwiz.com, powered by Kajabi. Custom AI tools may be hosted on ChatGPT via OpenAI. We are not responsible for any data breaches, platform failures, or service disruptions caused by these third-party providers. Your use of these platforms is also subject to their own terms and policies.

13. Privacy Policy

We respect your privacy and are committed to protecting your personal information.

Information we collect. Information you provide directly, such as your name, email, phone number, and payment details required to register, purchase, or interact. Information collected automatically, such as your IP address, browser type, pages visited, and essential cookies.

How your data is handled. Our course platform, Kajabi, uses SSL encryption and secure servers to protect your personal information and operates under its own privacy policy. We do not have access to data you enter into any of our GPTs within ChatGPT, which is governed by the OpenAI Privacy Policy.

Your rights. You can delete your account or adjust your preferences through your account profile. We comply with applicable privacy laws, including GDPR, CCPA, and LGPD. You may request access to, correction of, or deletion of your data by emailing alejandra@chiefaiwiz.com, and we will respond within 30 days.

14. Cookie Policy

We use essential cookies to make the Sites work. For non-essential cookies, we will ask for your consent. See our Privacy Policy above for more detail.

15. User Conduct

Use the Sites respectfully. Do not post offensive, illegal, or infringing content. Do not attempt to manipulate the Sites or access other users’ data. Breaking these rules may lead to account suspension without refund.

16. Disclaimer of Warranties and Limitation of Liability

Our products and Services are provided “as is,” without guarantees of any specific outcome or result. To the fullest extent permitted by law, Chief AI Wiz and 10X Cloud Value LLC are not liable for any direct, indirect, incidental, special, or consequential damages, economic losses, or damages arising from misuse of content, in any way connected to the use of the Services.

17. Indemnification

You agree to indemnify and hold 10X Cloud Value LLC harmless from any claims, damages, or expenses arising from your misuse of the Sites or your violation of these Terms.

18. Designated Agent for Copyright Complaints

In accordance with the Digital Millennium Copyright Act (DMCA), if you believe any content infringes on your copyright, you may contact our Designated Agent:

19. Arbitration and Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association under its rules. Each party covers its own costs unless the arbitrator decides otherwise. You waive your right to participate in a class action lawsuit. Arbitration will take place in Miami-Dade County, Florida.

20. Modification of Terms

We may update these Terms at any time. We will notify you by email or through a notice on the Sites at least 7 days before material changes take effect. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

21. Accessibility

We strive to meet WCAG 2.1 AA standards so the Sites are accessible to all users, including those with disabilities.

22. Service Interruptions

We may interrupt access to the Sites or to custom AI tools for maintenance or technical reasons without notice. We are not liable for losses arising from these interruptions.

23. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
